An ethical conflict arises when we must perform research in the interest of future patients, but that this may occasionally injure the interests of today''s patients. In the case of cognitively impaired persons, the question arises whether it is compatible with humane healthcare not only to treat, but also to use these patients for research purposes. Some bioethicists and theologians have formulated a general duty of solidarity, also pertaining to cognitively impaired persons, as a justification for research on these persons. (...) If one examines this thesis from the theory of justice according to John Rawls, it is revealed that such a duty of solidarity cannot necessarily be extrapolated from Rawls' conception of justice. This is at least true of Rawls' difference principle, because accordingto the difference principle only those measures are justifiable which serve the interest of the respective least well off. Those measures which would engender additional injury for the least well off could not be balanced by any utility according to Rawls. However, John Rawls' difference principle is subordinate to the first principle, which is that each person has an equal right to the most extensive basic liberty compatible with the same liberty for others. These primary goods are determined by the freedom and integrity of the person. This integrity of decisionally impaired persons would be in danger if one would abstain from research and thus forego the increase in knowledge related to their disease. Thus one could conclude, at least from Rawls' first principle, that society must take on a duty to guarantee the degrees of freedom for cognitively impaired persons and thus also support the efforts for their healing. Karen Quinlan, the American girl who has lain in deep coma for many months, is still 'alive', that is to say, her heart is still beating and brain death has not occurred. However, several other cases have raised difficult issues about the time of death. Dr Skegg argues that there is a case for a legal definition of death enshrined in statutory form. He suggests that many of the objections to a statutory provision on death are misplaced, and that a (...) statute concerning the occurrence of death could remove all doubts in the minds of both doctors and public as to whether a 'beating heart cadaver' was dead or alive for legal purposes. Science is not taken for granted any longer. Society, politics and the media pose critical questions tending to censorship or at least control of science. How does science respond? It cannot exist and develop without freedom, but this does not mean freedom to amass knowledge and apply technological applications at any price and without restrictions. Science should be autonomous, but is not value-free. A distintion is made between external and internal social/ethical problems. The former refer to questions of the social/ethical (...) context and consequences of scientific research, and the latter to the rules of ‘good practice’ and scientific integrity. The role of academies of science, and of associations of such academies (e.g. All European Academies (ALLEA)) in developing codes of good scientific practice and fostering a proper sense of scientific values and standards is further discussed. University president Sr. Margaret Carney, O.S.F., and Fr. Michael Cusato, O.F.M., director of The Franciscan Institute and dean of the School of (...) Franciscan Studies, presented the medal during an Academic Convocation at 7 p.m. in The Regina A. Quick Center for the Arts. A reception followed in the Dresser-Rand Atrium. During the Convocation, Giovanni Miccoli gave a presentation, “A Reading of the Christian Proposal of Francis According to His First Biographers,” continuing a longtime focus on the study of Francis of Assisi and his contributions to the Church. Professor Miccoli, who was born in Trieste, Italy, in 1933, studied in Pisa at the Scuola Normale Superiore and the Università, in Munich at the Monumenta Germaniae Historica, and London at the Warburg Institute. He has taught in Pisa, Venice and his native Trieste, where he is now a professor emeritus at the Università di Trieste. A historian of the Middle Ages and of the Roman Catholic Church, he has combined those loves to specialize first in the Gregorian Reformation, reforms undertaken within the Church under Pope Gregory VII at the end of the 11th century. Turning his eyes to more modern times, he is also an expert on the relationship between the Catholic Church and Fascism in Italy, including the questions related to Pius XII’s pontificate during World War II. His study of the Church in Italy during the Middle Ages led to a focus on Francis of Assisi and his impact on the Church, which led to his becoming one of foremost Franciscan scholars of modern times. Miccoli is particularly known for his contribution to 1974’s “La Storia Religiosa” (Religious History of Italy), which is the second volume of “Storia d’Italia” (History of Italy). In “La Storia Religiosa” he examined how Francis and his movement influenced the history and development of the Church in Italy. 8 GIOVANNI MICCOLI Since that time, he has published several major articles on Franciscan issues, largely drawing from early Franciscan documents and sources, which have been translated from Italian to English and published in Greyfriars Review, a publication of the Franciscan Institute. Philosophical Analysis in the Twentieth Century by Scott Soames reminds me of nothing so much as Lectures on Literature by Vladimir Nabokov. Both are works that arose immediately out of the needs of undergraduate teaching, yet each manages to say much of significance to knowledgeable professionals. Each indirectly provides an outline of the history of its field, through a presentation of selected major works, taken in chronological order and including items that are generally recognized as marking decisive turning points. Yet (...) neither Soames’s work nor Nabokov’s is a history in any conventional sense, both being immediately disqualified from that category by the general absence of coverage of minor and middling works and writers. The emphasis is pedagogical rather than historiographical: the emphasis is on introducing the student to the field through very close examination of the limited number of key texts selected for inclusion. The author’s distinctive personality is also apparent in both works. Each writer has a favorite theme he repeatedly sounds: for Soames, the danger of conflating the analytic, the a priori, and the necessary; for Nabokov, the philistinism of expecting an uplifting “message” from works of literary art. Each also includes some quirky, individual selections: The Right and the Good, The Strange Case of Dr. Jekyll and Mr. Hyde. Few others would have taken R. L. Stevenson to be up there with Dickens, Flaubert, and Proust, or W. D. Ross with Russell, Wittgenstein, and Quine. Each also sets aside for separate treatment elsewhere a major body of work one might have expected to be covered. Nabokov reserves Russian literature for a companion volume, while Soames gives only slight coverage to what he describes as “work in logic, the foundations of logic, and the application of logical techniques to the study of language” — a category that in practice turns out to include the bulk of the relevant material (by such writers as Frege, Carnap, and Tarski) that published originally in German without simultaneous English translation.. We shall succeed in not falling only if we step forward boldly and know not only what we are doing but also what we are up against in the making of a picture as well as in living in the world. (...) For the world, in its yawning impudence of death and the dance of blind eagerness, ambition, and noisy speechlessness, makes us look to art not, or not necessarily, to escape from the world but rather to learn how to take its measure. . . . There is a painting ["St. Vincent Ferrer Preaching"] joined to the Passion cycle in S. Polo which demonstrates as well as any paradox ever will how Giandomenico joined piety and irony in his religious art without curtailing the glory of either. He arrives, as it were, at a God-fearing irony. We see St. Vincent Ferrer preaching. He speaks so eloquently, so convincingly in praise of the divine truth, that light shines forth from him and angel's wings grow on his shoulders. Fascinated by the miracle but even more so by the saint's words, his audience sits spellbound at his feet; in the foreground, however, sits a youth, a fop perhaps, gorgeously dressed, with a singular smile on his face, his hand musingly poised to his cheek, who looks at us quizzically. Some scientific categories seem to correspond to genuine features of the world and are indispensable for successful science in some domain; in short, they are natural kinds. This book gives a general account of what it is to be a natural kind and puts the account to work illuminating numerous specific examples.

The no-miracles argument and the pessimistic induction are arguably the main considerations for and against scientific realism. Recently these arguments have been accused of embodying a familiar, seductive fallacy. In each case, we are tricked by a base rate fallacy, one much-discussed in the psychological literature. In this paper we consider this accusation and use it as an explanation for why the two most prominent `wholesale' arguments in the literature seem irresolvable. Framed probabilistically, we can see very clearly why realists (...) and anti-realists have been talking past one another. We then formulate a dilemma for advocates of either argument, answer potential objections to our criticism, discuss what remains (if anything) of these two major arguments, and then speculate about a future philosophy of science freed from these two arguments. In so doing, we connect the point about base rates to the wholesale/retail distinction; we believe it hints at an answer of how to distinguish profitable from unprofitable realism debates. In short, we offer a probabilistic analysis of the feeling of ennui afflicting contemporary philosophy of science. (shrink)

The fact that psychic life is not merely given externally and as mutual externality, but is given in its nexus, given by self-knowledge, by internal experience, constitutes the basic difference between psychological knowledge and knowledge of nature.

According to history texts, philosophers searched for a unifying natural law whereby natural phenomena and numbers are related. More than 2300 years ago, Aristotle postulated that nature requires minimum energy. More than 220 years ago, Euler applied the minimum energy postulate. More than 200 years ago, Lagrange provided a mathematical “proof” of the postulate for conservative systems. The resulting Principle of Least Action served only to derive the differential equations of motion of a conservative system. Then, 170 years ago, Hamilton (...) presented what he claimed to be a “general method in dynamics.” Hamilton's resulting “Law of Varying Action” was supposed to apply to both conservative and non-conservative systems and was supposed to yield either the differential equations of motion or the integrals of those differential equations. However, no direct evaluation of the integrals of motion ever resulted from Hamilton's law of varying action. In 1975, a scant 29 years ago, following five years of controversy with engineer mechanicians, Dr. Wolfgang Yourgrau, Editor, Foundations of Physics, published my first paper based on Aristotle's postulate, without mathematical proof. That and subsequent papers present, through applications, a true “general method in dynamics.” In this essay, I present the mathematical proof that is missing from my 1975 and subsequent papers. Six fundamental integrals of analytical mechanics are derived from Aristotle's postulate. First, however, Hamilton must be revisited to show why his H function and his “force function” prevents the law of varying action from being the general method in dynamics that he claimed it to be. I have found that Hamilton’s Law of Varying Action (HLVA), as Hamilton presented it, cannot be applied to systems for which the force function is non-integrable. In 1972, Dr. B.E. Gatewood and Dr. D.P. Beres (then a graduate student) discovered that the end-point term associated with the principle of least action does not vanish. I named the new equation, “the general energy equation.” In 1973, because I was doing with it what Hamilton claimed could be done with HLVA, I simply assumed that this new equation was HLVA. I gave the new equation the misnomer HLVA. In 2001, I learned that I had made a grave mistake. I found that HLVA is at most a special case of the general energy equation. My interpretation of Aristotle's postulate permits one to by-pass the differential equations of motion completely for both conservative and non-conservative systems (no calculus of variations). We show that the set of ultimately true sentences in Hartry Field's Revenge-immune solution model to the semantic paradoxes is recursively isomorphic to the set of stably true sentences obtained in Hans Herzberger's revision sequence starting from the null hypothesis. We further remark that this shows that a substantial subsystem of second-order number theory is needed to establish the semantic values of sentences in Field's relative consistency proof of his theory over the ground model of the standard natural numbers: -CA0 (...) (second-order number theory with a -comprehension axiom scheme) is insufficient. We briefly consider his claim to have produced a solution to the semantic paradoxes by introducing this conditional. When we ask what natural kinds are, there are two different things we might have in mind. The first, which I’ll call the taxonomy question, is what distinguishes a category which is a natural kind from an arbitrary class. The second, which I’ll call the ontology question, is what manner of stuff there is that realizes the category. Many philosophers have systematically conflated the two questions. The confusion is exhibited both by essentialists and by philosophers who pose their accounts in (...) terms of similarity. It also leads to misreading philosophers who do make the distinction. Distinguishing the questions allows for a more subtle understanding of both natural kinds and their underlying metaphysics. (shrink)

The Homeostatic Property Cluster (HPC) account of natural kinds has become popular since it was proposed by Richard Boyd in the late 1980s. Although it is often taken as a defining natural kinds as such, it is easy enough to see that something's being a natural kind is neither necessary nor sufficient for its being an HPC. This paper argues that it is better not to understand HPCs as defining what it is to be a natural kind but instead as (...) providing the ontological realization of (some) natural kinds. (shrink)

The accepted narrative treats John Stuart Mill’s Kinds as the historical prototype for our natural kinds, but Mill actually employs two separate notions: Kinds and natural groups. Considering these, along with the accounts of Mill’s nineteenth-century interlocutors, forces us to recognize two distinct questions. First, what marks a natural kind as worthy of inclusion in taxonomy? Second, what exists in the world that makes a category meet that criterion? Mill’s two notions offer separate answers to the two questions: natural groups (...) for taxonomy and Kinds for ontology. This distinction is ignored in many contemporary debates about natural kinds and is obscured by the standard narrative that treats our natural kinds just as a development of Mill’s Kinds. (shrink)

Kyle Stanford has recently claimed to offer a new challenge to scientific realism. Taking his inspiration from the familiar Pessimistic Induction (PI), Stanford proposes a New Induction (NI). Contra Anjan Chakravartty’s suggestion that the NI is a ‘red herring’, I argue that it reveals something deep and important about science. The Problem of Unconceived Alternatives, which lies at the heart of the NI, yields a richer anti-realism than the PI. It explains why science falls short when it falls short, and (...) so it might figure in the most coherent account of scientific practice. However, this best account will be antirealist in some respects and about some theories. It will not be a sweeping antirealism about all or most of science. (shrink)

We show how in the hierarchies${F_\alpha }$of Fieldian truth sets, and Herzberger’s${H_\alpha }$revision sequence starting from any hypothesis for${F_0}$ that essentially each${H_\alpha }$ carries within it a history of the whole prior revision process.As applications we provide a precise representation for, and a calculation of the length of, possiblepath independent determinateness hierarchiesof Field’s construction with a binary conditional operator. We demonstrate the existence of generalized liar sentences, that can be considered as diagonalizing past the determinateness hierarchies definable in Field’s recent (...) models. The ‘defectiveness’ of such diagonal sentences necessarily cannot be classified by any of the determinateness predicates of the model. They are ‘ineffable liars’. We may consider them a response to the claim of Field that ‘the conditional can be used to show that the theory is not subject to “revenge problems”.’. (shrink)

Some philosophers understand natural kinds to be the categories which are constraints on enquiry. In order to elaborate the metaphysics appropriate to such an account, I consider the complicated history of scurvy, citrus, and vitamin C. It may be tempting to understand these categories in a shallow way (as mere property clusters) or in a deep way (as fundamental properties). Neither approach is adequate, and the case instead calls for middle-range ontology: starting from categories which we identify in the world (...) and elaborating their structure, but not pretending to jump ahead to a complete story about fundamental being. Reflection Principles are commonly thought to produce only strong axioms of infinity consistent with V = L. It would be desirable to have some notion of strong reflection to remedy this, and we have proposed Global Reflection Principles based on a somewhat Cantorian view of the universe. Such principles justify the kind of cardinals needed for, inter alia , Woodin’s Ω-Logic.

Consider the concept combination ‘pet human’. In word association experiments, human subjects produce the associate ‘slave’ in relation to this combination. The striking aspect of this associate is that it is not produced as an associate of ‘pet’, or ‘human’ in isolation. In other words, the associate ‘slave’ seems to be emergent. Such emergent associations sometimes have a creative character and cognitive science is largely silent about how we produce them. Departing from a dimensional model of human conceptual space, this (...) article will explore concept combinations, and will argue that emergent associations are a result of abductive reasoning within conceptual space, that is, below the symbolic level of cognition. A tensor-based approach is used to model concept combinations allowing such combinations to be formalized as interacting quantum systems. Free association norm data is used to motivate the underlying basis of the conceptual space. It is shown by analogy how some concept combinations may behave like quantum-entangled particles. Two methods of analysis were presented for empirically validating the presence of non-separable concept combinations in human cognition. One method is based on quantum theory and another based on comparing a joint probability distribution with another distribution based on a separability assumption using a chi-square goodness-of-fit test. Although these methods were inconclusive in relation to an empirical study of bi-ambiguous concept combinations, avenues for further refinement of these methods are identified. (shrink)

Homeostatic property clusters (HPCs) are offered as a way of understanding natural kinds, especially biological species. I review the HPC approach and then discuss an objection by Ereshefsky and Matthen, to the effect that an HPC qua cluster seems ill-fitted as a description of a polymorphic species. The standard response by champions of the HPC approach is to say that all members of a polymorphic species have things in common, namely dispositions or conditional properties. I argue that this response fails. (...) Instances of an HPC kind need not all be similar in their exhibited properties. Instead, HPCs should instead be understood as unified by the underlying causal mechanism that maintains them. The causal mechanism can both produce and explain some systematic differences between a kind’s members. An HPC kind is best understood not as a single cluster of properties maintained in stasis by causal forces, but as a complex of related property clusters kept in relation by an underlying causal process. This approach requires recognizing that taxonomic systems serve both explanatory and inductive purposes. (shrink)

Part C of this three part series is the presentation from the Oxford style debate held at the Tenth Annual International Conference Promoting Business Ethics between Laura Hartman, J.D., and Dr. Moses Pava on topics related to the EverQuest® v. EverCrack case. In a traditional Oxford style debate, two debaters take opposing viewpoints and the third debater argues the neutral position. At the Conference, the modified format featured the two debaters presenting diametrically opposing views – corporate responsibility versus personal (...) responsibility. This modified format was also used during the Ethics Awareness Week, with University professors presenting the debate before the student body. Ms. Hartman’s position focused on the personal responsibility by Mr Woolley while Dr. Pava opined that Sony Online Entertainment had corporate responsibility toward Mr. Woolley and all other individuals similarly situated.
